This Sweepstakes ("Contest") begins 12.00 PM Eastern time, on November 2nd, 2011 and will end at 23:59 PM Eastern time on December 31, 2011, the "Sweepstakes Window". Participants enter the Contest by providing their name, email address and other information and agreeing to these rules and regulations. Any entry by the participant constitutes consent to participate in this Contest and agreement with these Rules. All entries will be the property of the Sponsor. The Sponsor is not responsible for lost, late, incomplete, or otherwise misdirected entries that are processed late or incorrectly or are lost due to computer or electronic malfunction or other error. To claim a prize, you must provide your correct name, email address and other information. NO PURCHASE IS NECCASSRY FOR ANY PART OF THE CONTEST.

 

Sweepstakes is open to any living persons in Canada and the United States, who are 18 years of age or older at the time of entry. APPLICABLE LOCAL, STATE, FEDERAL, AND INTERNATIONAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED BY LAW. SWEEPSTAKES IS NOT AVAILABLE TO RESIDENTS OF QUEBEC, RHODE ISLAND, NEW YORK, AND FLORIDA. By entering into this Sweepstakes, the participant shall be deemed to have read and agreed to be bound by these terms and conditions, and by the decisions of Sponsors and their affiliated entities, which shall be final and binding in all respects. In order to claim the prize and be declared a winner the selected entrant will be required to complete and sign a declaration and release statement, in order to; confirm compliance with the rules and regulations, accept the prize as awarded, without substitution, release the Sponsor and its affiliated companies from any liability, as described more fully below. Where required by law, you may be required to correctly answer, without assistance of any kind, a mathematical skill-testing question to be administered by email or telephone at a pre-arranged mutually convenient time.

 

Failure by any selected entrant to complete, sign and return any of the aforementioned documents within 14 business days after notification is sent to the email address on the selected entrant’s entry, or fail to return of prize documents, may result in forfeiture of the prize. At the sole discretion of the Sponsor, an alternate winner may be selected or the prize award may be cancelled. At the sole discretion of the Sponsor, if a selected entrant cannot be contacted in a timely fashion, or if for any other reason the prize cannot be awarded, another sweepstakes entry may be randomly selected by draw until the prize has been awarded. Where required by law, failure to correctly answer the skill-testing question will result in disqualification, the forfeiture of his or her interest in the prize, and at the sole discretion of the Sponsor, the random selection of a substitute winner from among all remaining eligible entries. 

 

Communication will be entered into only with selected entrants.

 

Sponsors and their subsidiaries and affiliated entities are not responsible or liable for entries that are entered by other than human means (such as by an automated computer program or any non-human mechanism, entity, or device), in excess of the stated limit, or for entries that are illegible, late, destroyed, lost, misplaced, stolen, misdirected, tampered with, deleted, damaged, incomplete, or otherwise not in compliance with these official rules, and all such entries will be disqualified. By participating in the Sweepstakes, each registrant/entrant agrees and acknowledges: to be bound by these official rules, all Sponsors-related terms and conditions, as well as the decisions of Sponsors which are final and binding in all respects; to waive any rights to claim ambiguity with the official rules; and that Sponsors and their affiliated entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: participation in the Sweepstakes; acceptance/possession (including, but not limited to, delays by shipping companies), defects, and/or use/misuse of a prize (including, but not limited to, cancellation/postponement); discontinued prizes; human error; incorrect or inaccurate transcription of registration and/or account information; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, or internet service provider utilized by Sponsors; interruption or inability to access Sponsors, their affiliated entities and their respective websites, or any online service via the internet due to hardware or software compatibility problems; any damage to participant's (or any third person's) computer and/or its contents related to or resulting from any part of the Sweepstakes; any lost/delayed data transmissions, omissions, interruptions, defects; and/or any other errors or malfunctions, even if caused by the negligence of Sponsors or any one of their affiliated entities. Each participant further agrees to indemnify and hold harmless the Sponsors and their subsidiaries and affiliated entities from and against any and all liability resulting or arising from the Sweepstakes and to release all rights to bring any claim, action or proceeding against Sponsors or their affiliated entities, and hereby acknowledge that Sponsors and their subsidiaries and affiliated entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to a prize, including express warranties provided exclusively by a prize supplier that may be sent along with a prize. Sponsors and/or their subsidiaries and affiliated entities shall in no event be liable for any injury, damage, loss, expense, accident, delay, inconvenience or irregularity that may be caused or contributed to (1) by any wrongful, negligent or unauthorized act or omission on the part of any of the prize suppliers or any of their agents, servants, employees or independent contractors, (2) by any wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of Sponsors, or (3) by any other cause, condition or event whatsoever beyond the control of Sponsors or their parents, subsidiaries and affiliated companies. Title of this Sweepstakes may change during the Sweepstakes. ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK ALL LEGAL AND EQUITABLE REMEDIES FROM AND AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Additionally, any attempt to cheat the Sweepstakes, as determined at the sole discretion of the Sponsors, may result in immediate disqualification of the entrant, as well as other possible consequences, including disqualification from any and all existing and future Offers. Any attempt to cheat by creating fake profiles will be looked upon very seriously, and can result in immediate and permanent ban, and possible further action. Irrelevant entries, as deemed irrelevant at the sole discretion of Sponsors, and those using copyrighted content may be removed and disqualified from the Sweepstakes. In the event of a dispute, entries made by Internet will be declared made by the authorized account holder of the username submitted at time of concept. "Authorized account holder" is defined as the natural person who is assigned to an email address entered into the Sponsors system. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, unavailable funds or any other causes beyond the control of the Sponsors, then the Sponsors reserve the right at their sole discretion to cancel, terminate, modify, extend or suspend the Sweepstakes.

 

One grand prize winner will be selected from all eligible entries. The grand prize winner will receive: 

Monograms 4-day / 3 night Berlin Getaway trip for two which includes a 3 night stay at selected hotel based on double occupancy, half-day sightseeing tour, full buffet breakfast daily, local destination representative. Note: International and domestic airfare and transfers between the airport and hotel are NOT INCLUDED. Prize valid through December 31, 2012 – some restriction may apply.

Your actual odds of winning depend upon the number of eligible entries received. For example, if 1000 eligible entries are received, your odds of winning would be 1:1000. The Sponsor cannot accurately estimate how many eligible entries will be received during the Sweepstakes Window. 

 

Following the end of the Sweepstakes Window, the Sponsor shall schedule the prize selection at it's own discretion and within the time period allowed by Law. 

 

ALL INTERNATIONAL, FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER. All costs and expenses not specified herein are the sole responsibility of the winner. No substitutions, except at Sponsor's sole discretion, in the event of prize unavailability. Prize is not transferable, except at discretion of the Sponsor. 

 

The information that you provide in connection with the Contest may be used for internal purposes and to send you information about the Sponsor's products and special promotions but will not be provided to third parties, except as necessary for the administration of the Contest or as required by law or legal process. Entry constitutes permission to post winner's names on Website and to use winner's name, and/or likeness for purposes of advertising and promotion without further compensation unless prohibited by law. 

 

The Sweepstakes and these official rules shall be construed and governed in accordance with the laws of the Canada and United States.
